Enterlink and its resident AI, VEA, your Virtual Entertainment Ambassador, is your digital concierge for navigating the vibrant world of virtual events. Our platform is designed to connect you with a plethora of virtual experiences, from lively social gatherings to intriguing events, tailored to your preferences.

By accessing, browsing, or using Enterlink, you acknowledge that you have read, understood, and agree to be bound by the following Terms and Conditions. These Terms govern your use of the app and all related services provided by Enterlink. They are crucial in ensuring a safe, reliable, and respectful environment for all users.

If you do not agree with any part of these Terms, please do not use our app. Remember, as we are in a beta phase, we appreciate your feedback and patience as we evolve and improve our service.

Definitions

In the context of these Terms and Conditions, the following definitions apply:

Enterlink: The term "Enterlink" or "App" refers to the Enterlink application and website, in its current beta version, including its web application accessible through websites such as heyvea.com, enterlink.events and enterl.ink, any mobile application versions, supporting downloadable applications, and all third-party integrations. This encompasses all features, functionalities, content, and services offered by Enterlink.

  2. User: "User" or "You" refers to any individual who accesses or uses Enterlink.

  3. Content: "Content" includes all forms of data, text, graphics, images, music, software, audio, video, information, or other materials available through Enterlink.

  4. Virtual Event: A "Virtual Event" is any online gathering, activity, or experience that users can RSVP to, participate in, or follow through Enterlink.

  5. RSVP: "RSVP" denotes the act of registering or expressing intent to participate and/or join in a Virtual Event listed on Enterlink.

  6. Profile: "Profile" refers to the personal user account created to access and interact with Enterlink's features, including RSVPs, event creation, and following other users.

  7. Beta Version: "Beta Version" signifies the current developmental stage of Enterlink, featuring limited functionalities subject to testing, feedback, and further development.

  8. Terms or Agreement: "Terms" or "Agreement" denote these Terms and Conditions, subject to periodic updates or amendments.

  9. Service: "Service" encompasses the functionalities, features, and services provided by Enterlink as outlined in these Terms and Conditions.

  10. Third-Party Integration: "Third-Party Integration" refers to any feature, tool, or service provided by external parties or platforms that integrate with Enterlink to enhance user experience. This includes, but is not limited to, integrations like Discord and VR overlay tools.

  11. Activity Timeline or My Story: "Activity Timeline" or "My Story" is a personalized feature that compiles and presents a user's activities, including event participation, photos shared, and virtual worlds visited, exclusively for their own review and reminiscence. This compilation is based on activities across various platforms as facilitated by Enterlink. The visibility of specific posts within this timeline to other users is contingent upon those posts being shared by the User.

  12. VEU Inc.: "VEU Inc." is the Delaware-based company operating out of California, responsible for developing and managing Enterlink and related services.

User Accounts

  1. Account Creation: To use Enterlink, you must create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. VEU Inc., a Delaware based company operating out of California, reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.
  2. Account Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account, whether your password is with our service or a third-party service. You agree to notify VEU Inc. immediately upon becoming aware of any breach of security or unauthorized use of your account.
  3. Account Usage: Enterlink, including related products such as Enterverse or its community events, is a product of VEU Inc. It is intended for personal and non-commercial use. You may not use Enterlink for any commercial purpose without the express consent of VEU Inc.
  4. User Conduct: You agree not to engage in any activity that may disrupt, damage, or negatively affect the functionality and service of Enterlink. This includes abiding by all applicable laws and regulations and respecting the rights and dignity of others.
  5. Age Restrictions: Enterlink is not intended for individuals under the age of 14. If you are under 14, you are not permitted to create an account or use Enterlink. Users between the ages of 14 and 18 (or the applicable age of majority in your jurisdiction) may use Enterlink only with the consent and under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
  6. Account Termination: VEU Inc. reserves the right to terminate or suspend your account at any time for any reason, including but not limited to a violation of these Terms and Conditions.

User Conduct

  1. Compliance with Laws: You agree to use Enterlink in compliance with all applicable local, state, national, and international laws, rules, and regulations.

  2. Prohibited Activities: You are prohibited from using Enterlink to:

    • Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, or otherwise objectionable material.
    • Post or transmit material that promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
    • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
    • Engage in fraudulent activities or make fraudulent offers or claims.
    • Distribute viruses or any other technologies that may harm VEU Inc., Enterlink, or the interests or property of Enterlink users.
    • Access, tamper with, or use non-public areas of Enterlink, VEU Inc.’s computer systems, or the technical delivery systems of VEU Inc.’s providers.

  3. Content Responsibility: You are solely responsible for the content that you post, upload, link to, or otherwise make available via Enterlink. You warrant that you have all necessary rights to such content and that you’re not infringing or violating any third party’s rights by posting it.

  4. Respectful Interaction: Engage respectfully with other users. Bullying, harassment, or other types of aggressive behavior towards other users are strictly prohibited.

  5. Reporting Violations: If you witness or are subjected to inappropriate behavior or content while using Enterlink, you are encouraged to report it to VEU Inc. for review and potential action.

  6. Consequences of Violations: Violation of these User Conduct guidelines may result in suspension or termination of your Enterlink account and legal action if necessary.

Content and Intellectual Property Rights

  1. User-Generated Content: Enterlink allows users to create, post, and share content. You retain all rights to any original content you submit, post, or display on or through Enterlink. However, by submitting, posting, or displaying content on or through Enterlink, you grant VEU Inc. a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods (now known or later developed).

  2. VEU Inc. Content: All content provided by VEU Inc. on Enterlink, including but not limited to, text, graphics, images, audio, video, software, algorithms, and their selection and arrangement, is owned by or licensed to VEU Inc., and is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

  3. Copyright Complaints and Copyright Agent: VEU Inc. respects the intellectual property rights of others and expects its users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law.

  4. Content Review: VEU Inc. reserves the right, but is not obligated, to review, monitor, or remove user-generated content at our sole discretion and at any time, without notice, for any reason.

  5. Prohibited Content: You agree not to post, upload, transmit, or otherwise disseminate through Enterlink any content that:

    • Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
    • Is illegal, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or harmful in any other way.
    • Contains hate speech, promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
    • Is obscene, pornographic, or otherwise violates community standards.
    • Contains or promotes violence or actions that are threatening to any other person.
    • Contains false, misleading, fraudulent, or deceptive claims or content.
    • Violates any laws or regulations.

  1. Collection: VEU Inc. collects personal information you provide when using Enterlink. This may include your name, email address, preferences, interests, and other data required for providing personalized recommendations and services.

  1. Activity Tracking: If you opt to use certain features of Enterlink, VEU Inc. may track and compile your activities across various virtual platforms. This includes, but is not limited to, photos shared, events participated in, or virtual worlds visited. This information may be used to create a personal activity timeline for your review and reminiscence.
  2. Integration Overview: Enterlink may integrate with various third-party platforms and services, such as Discord, to enhance user experience. These integrations enable features like event coordination, activity tracking, and social interactions.
  3. Data Collection and Usage: When you engage with third-party integrations or utilize activity tracking features, VEU Inc. may collect and process data related to your activities. This data collection includes, but is not limited to, event participation, RSVPs, shared content, and platform interactions. The primary purposes of collecting this data are to enhance the functionality of Enterlink, provide personalized user experiences, aid in event organization, support community engagement initiatives, and improve the recommendation algorithm for the benefit of users.
  4. User Consent and Control: Your use of third-party integrations and activity tracking is entirely voluntary and subject to your consent. You will have the ability to manage your preferences and can opt out of specific integrations or tracking features at any time.
  5. Compliance and Privacy: VEU Inc. is committed to ensuring that all third-party integrations and activity tracking adhere to our privacy policies and data protection standards. However, your activities on these third-party platforms may also be governed by their own privacy policies.

Limitation of Liability

  1. Scope of Liability: VEU Inc., its affiliates, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from (i) your access to or use of or inability to access or use Enterlink; (ii) any conduct or content of any third party on Enterlink; (iii) any content obtained from Enterlink; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
  2. Liability Cap: In no event will VEU Inc.'s aggregate liability for all claims relating to Enterlink exceed the greater of $100 USD or the amount you paid VEU Inc., if any, in the last 12 months.
  3. Jurisdictional Limitations: Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you to the extent such jurisdiction's law is applicable to this agreement.
  4. Essential Basis: The limitations set forth in this section will not limit or exclude liability for the gross negligence, fraud, or intentional misconduct of VEU Inc. or for any other matters in which liability cannot be excluded or limited under applicable law.

VEU Inc. provides Enterlink 'as is' and without warranty. We make no representations or warranties about the completeness, accuracy, reliability, suitability, or availability with respect to Enterlink or the information, products, services, or related graphics contained on Enterlink for any purpose.

  • Content Accuracy and Completeness: Any reliance you place on such information is strictly at your own risk. The content on Enterlink may include technical, typographical, or photographic errors. VEU Inc. does not warrant that any of the materials on Enterlink are accurate, complete, or current. We may make changes to the materials contained on Enterlink at any time without notice. However, we do not make any commitment to update the materials.
  • Warranty Disclaimers: We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Enterlink and its services will be uninterrupted or error-free, that defects will be corrected, or that the app or the server that makes it available are free of viruses or other harmful components.
  • Global Availability: Information on Enterlink may contain references to products or services not available in your country or region. Such references do not imply that VEU Inc. intends to announce these products or services in your country.
  • Third-Party Links: Links to third-party websites on Enterlink are provided solely as a convenience to you. VEU Inc. has not reviewed all of these third-party sites and does not control and is not responsible for any of these sites or their content. Thus, we do not endorse or make any representations about them, or any information, software, or other products or materials found there, or any results that may be obtained from using them.

User-Generated Content Disclaimers:

  • Events, Worlds, and Groups: VEU Inc. does not endorse, guarantee, or assume responsibility for any event, virtual world, or group listed, recommended or accessible through Enterlink. Users are advised to exercise their own discretion and judgment in participating in these events, exploring these worlds, or joining these groups. VEU Inc. shall not be held liable for any discrepancies, cancellations, or disputes arising from these user-generated contents.

Indemnification

You agree to indemnify, defend, and hold harmless VEU Inc., its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of Enterlink, your violation of these Terms of Service, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. This indemnification extends to direct and indirect damages, losses, and expenses incurred by VEU Inc.

In addition, you will indemnify and hold VEU Inc. harmless from and against any claims brought by third parties arising out of your use of information accessed from Enterlink. This includes, but is not limited to, situations arising from your participation in any activities or events organized through Enterlink, or your interactions with any groups or communities formed through the platform.

You agree to be solely responsible for defending any claim, subject to VEU Inc.'s right to participate with counsel of its own choosing, and you will not in any event settle any claim without the prior written consent of VEU Inc.

It is your responsibility to stay informed about any changes to these terms, as your continued use of Enterlink after any changes implies your acceptance and agreement to those changes. However, indemnification obligations will not apply to the extent that any claim, damage, or loss arises from VEU Inc.'s proven gross negligence or willful misconduct.

Changes to Terms

VEU Inc. reserves the right, at its sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use Enterlink after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Enterlink.
